Pittsburgh SSD Appeal Attorneys
The Social Security Administration denies about two-thirds of initial Social Security Disability (SSD) claims. If your application was denied, it does not mean your injury is illegitimate or that you can never get benefits. It does, however, mean that it will take more time to get your benefits, because you must exercise your right to appeal.
At The Law Offices of Kenneth Hiller, PLLC, we represent clients in Pittsburgh, Erie and throughout western Pennsylvania at all stages of the disability claims process, including any appeals that are necessary. Unlike some firms that offer no real help beyond the initial application or the first stage of an appeal, we will be by your side at all stages, doing everything possible to help you obtain the benefits you need and deserve.
To arrange a free initial consultation with an experienced, skilled Pittsburgh SSD appeal lawyer, please call 716-213-6378 or toll free 888-322-9399. You can also contact our law firm online.
Why Was My Initial Claim Denied?
The SSA often denies initial claims based on its view that the applicant failed to show " total disability" and the inability to be "gainfully employed." This does not mean that it disregarded your medical diagnosis; it just means that the initial application did not prove the disability to the SSA's satisfaction. One of the main reasons why you need a disability lawyer is to gather medical records and other evidence to make your SSD appeal as strong as possible.
Understanding the Social Security Appeals Process
After an initial claim denial, the appeals process begins. There are potentially four levels of review that a claim can reach, and each step must be completed in order. The process can be lengthy, but our Pittsburgh disability attorneys will keep you informed and up to date throughout.
- Reconsideration: Within 60 days of the denial of the initial claim, our legal team will ask the SSA to take a second look at the application.
- ALJ hearing: The hearing before the administrative law judge is the best opportunity to obtain benefits after a denial. Preparation is critical. Our legal team will thoroughly analyze your case and prepare you to testify. It usually takes 15 to 18 months to get a hearing, but it can be expedited in certain situations.
- Appeals Council: If a claim is denied by the ALJ, we can pursue the case to the Appeals Council in Falls Church, Virginia. You will not have to travel to Falls Church; this appeal is entirely in written form. Our firm writes legal briefs designed to persuade the Council that the judge was wrong.
- Federal court: The final stage of a claim is to file a lawsuit in federal court. Many law firms are not willing or able to take a case this far, but we certainly are. We will skillfully prepare the case and aggressively pursue benefits if the SSA wrongly denies a client's claim.
